Phil Davis · 1 year agoTrue all the above. I've found DomainTools.com is good about not ratting out your searches. I've never lost one with them. The TM thing is always an issue, and correct me if I'm wrong, but I don't think there's a 100% way to know a name is trademarkable until it gets approved by the TM clerk. I had one that was clear on the search but someone filed for the same name one week earlier. It took months to show up. I refer most of my clients to their attorney. That's a touchy one. Great info!

alyciademesa · 1 year agoThanks Phil. And yes, it's true - you can use a TM on a provisional basis during the application process but it is *not* set in stone until approved by USPTO which is many months after the initial application. Hence, why you need more than one name up your sleeve!

Marc Girolimetti · 1 year agoI hear you on your comment about names and domains being so limited by now. This is why I try to take a page from Japanese television. The next product I name, regardless of purpose, is going to be called "Super Happy Extravagant Awesome Fun Time starring Mr Fantastic Man". It's all we have left.
